These Terms and Conditions govern your use of the Magical Tanzania website (magicaltanzania.com) and your booking of safari services with Magical Tanzania Ltd ("Magical Tanzania," "we," "us," or "our"), a Tanzanian registered company based in Arusha, Tanzania. By submitting an enquiry or making a booking with us, you agree to be bound by these terms. Please read them carefully before booking.

1. Our Services

Magical Tanzania Ltd operates as a direct safari operator. We design, plan, and deliver safari experiences throughout Tanzania, including Kilimanjaro climb extensions, Zanzibar beach extensions, and multi-destination Tanzania itineraries. We own our safari vehicles, employ our own guides, and contract directly with lodges, camps, and ground handlers. We are not a broker or travel agency acting as an intermediary.

The specific services you book are described in your booking confirmation and itinerary proposal. Any changes to the booked services will be communicated to you in writing before your departure date.

2. Booking Process

To begin the booking process, you submit an enquiry through our website, by email, or via WhatsApp. We will respond with a personalised itinerary proposal and price estimate based on your stated requirements. To confirm your booking, you must:

  • Review and confirm your itinerary in writing (email is sufficient)
  • Pay the required deposit (see Payment Terms below)
  • Provide proof of travel insurance (see Travel Insurance below)

A booking is confirmed only when we have received your deposit payment and travel insurance confirmation in writing. Upon confirmation, you will receive a booking confirmation document detailing your full itinerary, emergency contacts, and pre-departure information.

3. Payment Terms

Deposit: A deposit of 30% of the total safari price is required to confirm your booking. This deposit is non-refundable except in the circumstances described in Section 4 (Cancellation).

Balance Payment: The remaining 70% balance is due no later than 60 days before your scheduled arrival date in Tanzania. If the balance payment is not received by the due date, we reserve the right to cancel the booking and retain the deposit.

Bookings within 60 days of departure: For bookings made fewer than 60 days before arrival, the full amount is due immediately upon confirmation.

Currencies and fees: All prices are quoted in US Dollars (USD) unless explicitly stated otherwise. Bank transfer fees and currency conversion costs are the responsibility of the client. We accept payment by bank transfer, credit card (via secure payment link), and PayPal. Payment by credit card may incur a processing fee of up to 3% which will be disclosed before payment.

4. Cancellation by the Client

If you need to cancel your booking, you must notify us in writing by email. The cancellation takes effect on the date we receive your written notice. Refunds are calculated as follows:

  • 60+ days before arrival: Full refund of amounts paid minus the deposit (30%) and a $100 administrative processing fee.
  • 30–59 days before arrival: 50% refund of the total safari price, or a credit note valid for 12 months for future travel with Magical Tanzania.
  • Less than 30 days before arrival: No refund is payable. The full safari price is retained.

We strongly recommend that you purchase travel insurance with trip cancellation coverage at the time of booking to protect yourself against unforeseen circumstances that may force you to cancel (see Section 7: Travel Insurance).

In the event of a partial cancellation — for example, reducing the number of travellers in your group — the per-person price may be recalculated and any price difference refunded or charged accordingly.

5. Cancellation or Changes by Magical Tanzania

In the unlikely event that Magical Tanzania must cancel or materially change your booking due to circumstances beyond our control (see Section 10: Force Majeure), we will:

  • Offer you a full refund of all amounts paid to Magical Tanzania, or
  • Offer you an alternative safari of comparable or superior standard, or
  • Offer you a credit note valid for 12 months for future travel with Magical Tanzania.

Magical Tanzania is not liable for any additional costs you may incur such as international flights, travel insurance premiums, or visa fees in the event of a cancellation or change initiated by us.

6. Changes to Itinerary

The itineraries we propose are planned well in advance of your travel dates. While we make every effort to deliver the confirmed itinerary, we reserve the right to make minor changes to accommodation, specific lodges, or activity providers if necessary — provided the overall character and quality of the safari experience is maintained. We will notify you of any significant changes as soon as possible.

In safari environments, flexibility is essential. Wildlife sightings, weather conditions, road conditions, and park authority decisions can all affect the exact routing of game drives. Your guide has the professional judgment to make real-time adjustments to maximise your safari experience. Such adjustments are not considered changes to the booking and do not entitle you to a refund.

7. Travel Insurance

Travel insurance covering medical evacuation by air is mandatory for all clients booking a safari with Magical Tanzania. You must provide proof of valid travel insurance — including emergency evacuation coverage — before your booking is confirmed. We reserve the right to cancel your booking without refund if proof of insurance is not provided at least 30 days before your arrival.

We recommend that your policy also covers: trip cancellation, trip interruption, personal belongings and equipment, and personal liability. Tanzania's safari parks are remote — medical facilities are limited outside of Arusha and Dar es Salaam. Air evacuation to Nairobi or South Africa can cost $20,000–$50,000 USD without insurance. Standard travel insurance policies often do not include this; please verify with your insurer before purchasing.

8. Health and Fitness

You are responsible for ensuring that you are physically and medically fit to undertake the safari activities you have booked. Certain safari activities — particularly game walks, fly-camping, and any overland travel on rough roads — carry inherent physical demands. Please inform us of any medical conditions, physical disabilities, or limitations at the time of enquiry so we can advise on the suitability of our itineraries.

For Kilimanjaro climbs, specific fitness requirements apply. Please refer to the fitness requirements outlined in your climb proposal. Climbers with pre-existing cardiovascular, respiratory, or circulatory conditions should consult their physician before booking. Our guides reserve the right to recommend that a client descends if they observe symptoms of altitude illness or physical exhaustion that in their professional judgment pose a safety risk.

9. Liability

Magical Tanzania Ltd acts as a direct operator and is responsible for the services we directly provide — including transport, guiding, accommodation bookings within our contracted network, and meal provision. Our liability is limited to the total amount paid by the client for the booking.

Magical Tanzania Ltd is not liable for:

  • Events or circumstances outside our reasonable control, including but not limited to: acts of God, weather events, natural disasters, political instability, flight cancellations or delays, airline failures, government decisions, or actions of third parties beyond our control (see Section 10: Force Majeure).
  • Any personal injury, death, or property loss that results from the client's own actions, negligence, or failure to follow the guidance of our guides.
  • Any indirect, consequential, or incidental损失 including loss of enjoyment, missed activities, or wasted holiday time arising from circumstances beyond our control.
  • The acts or omissions of third-party service providers — including airlines, hotels, lodges, and camps — beyond our reasonable selection and supervision.

10. Force Majeure

Neither party shall be liable for any failure or delay in performing their obligations under these terms where such failure or delay results from force majeure events including but not limited to: natural disasters, civil unrest, war, terrorism, epidemic or pandemic, government travel restrictions, airport closures, or any other cause beyond the reasonable control of either party. If a force majeure event prevents Magical Tanzania from delivering your safari, the provisions of Section 5 (Cancellation or Changes by Magical Tanzania) shall apply.

11. Client Conduct

You are expected to conduct yourself appropriately during your safari. Behaviour that is disruptive, threatening, or abusive toward our guides, staff, or other travellers may result in your immediate removal from the safari without refund. Our guides have professional discretion in managing group dynamics and ensuring the safety and enjoyment of all clients.

Tanzania's national parks and wildlife reserves have strict rules regarding off-road driving, proximity to wildlife, and environmental protection. You must follow your guide's instructions at all times in these environments. Violation of park rules may result in fines from the Tanzania National Parks Authority (TANAPA), for which Magical Tanzania cannot accept liability.

12. Complaints

If you have a complaint during your safari, please raise it immediately with your guide or our Arusha operations team so we can attempt to resolve it in real time. Most issues can be addressed quickly if we know about them. If a satisfactory resolution cannot be reached during your trip, please submit a formal written complaint to our Arusha office within 30 days of your return from safari. We will investigate and respond within 30 days of receiving your complaint.

13. Intellectual Property

All content on magicaltanzania.com — including text, photography, route maps, and design — is the intellectual property of Magical Tanzania Ltd or our content partners. You may not reproduce, distribute, or create derivative works from our content without written permission. Photos taken by our guides during your safari are for your personal use; we appreciate but do not require credit if you share them on social media.

14. Governing Law

These Terms and Conditions are governed by the laws of the United Republic of Tanzania. Any disputes arising from your booking shall be subject to the exclusive jurisdiction of the courts of Tanzania.
